Hodges and Associates May 15, 2013 « Result #1 Today at 9:01pm »

It is the Ides of May; I would therefore remind you all what Samuel Adams said: “It does not require a majority to prevail, but rather an irate, tireless minority keen to set brush fires in people’s minds.” Please continue to act accordingly.

I recently advised that I would have a statement for all on this date; here it is:

1. Let me start with a comment on the Bivens litigation. As has been widely disseminated by now, the United States Supreme Court denied our Petition for Certiorari. Many have asked, “What does this mean [for us shareholders]?” The specific legal effect is to fully and completely terminate the Bivens case. It means that for seven very courageous plaintiff shareholders, they are at no further risk. It means for all shareholders [putative class action members all] that the US Government is free from the threat of additional litigation, at least in the practical sense. It means as well, in my professional opinion, that the Supreme Court Justices are fully aware that the World Global Settlements (WGS), the Global Currency Reset (GCR), and all associated/reliant programs are in the final completion process; therefore, there being no need for the Court to grant Certiorari as a means of keeping the pressure on the politicians who have been so aggressive in delaying this.

2. I know, understand, and empathize with your angst, frustration and anger engendered by the outrageous delays which have occurred. However, it is a fact that we are a relatively small part of the pay-out scheme. The overall WGS and GCR, with particular focus on the GCR have been the primary cause of these delays; not because of incompetence or similar reasons, but because of the vicious tornados generated by the ‘cabal’ which I have previously referred to as ‘headwinds.’ We have truly confronted and battled the vilest, most contemptible, well financed forces for evil on the planet [more I cannot say at the moment]. Although we have won, securing the peace has proved to be a herculean task. We are now at that point, at least based upon all the evidence and advice from good people across this country, and around the world. You can not truly imagine yet the effect that all of this will have on you, your family, your city, your state and country, and indeed upon the world. It will be life changing for all.

3. To put it another way, the World Global Settlements, including the US Dollar Refunding Project, the Global Currency Reset and all the associated/reliant programs are real. They are the instruments of great change – part of a world wide re-distribution of wealth which includes some 20 countries revaluation [up and down] of their currency; and every country will have asset-backed currency. Yes, this does include Iraq and Vietnam which are the cheapest of the lot. The protocols governing implementation of these various programs have changed quite substantially as a result of the cabal’s interference as evidenced by the wholesale departure of many leaders and executives, and the arrest of more that 1,000 bankers for abetting financial fraud. The estimates of those who will be prosecuted after the completion of this, is in excess of 10,000. As I have said in the past, most of those I have denominated as ‘miscreants’ have, during these delays, been duly relieved of the money they stole [which has now been recovered by the US], and many others have been indicted.

4. Although CMKX payments were not originally connected with the WGS, it has always been the case that they were dependent on its occurrence. That is because Bob Maheu, who was one of the White Knights, worked so assiduously to “level the playing field” for more than 20 years. The concern has always been that since fiat currency systems always end up in the same place, the only correct way to compensate these shareholders, required ensuring that they received their payment in asset backed currency and could have access to a fair and transparent banking system. I was mistaken when I previously passed along ‘intel’ about Peter Maheu being fined; although he has in fact been before the Supreme Court and the World Court it resulted in no such fines – mea culpa. There are other reasons related to the big picture, which may also play a part in these continuing delays. While as it has turned out, any delay seems patently unfair, the simple fact is that we will not receive our payouts until the financial imbalance in the world has been corrected.

5. The bottom line is that you will be paid a great deal more than any have the right to expect [based on the amount of their investment]. In addition, you will receive a payment for the unconscionable length of payment delay. I cannot guarantee when this will happen; what I can tell you is that it will be very soon. What does that mean? – It means that the Global Currency Reset into the new international, fully transparent, all digital, 1024 bit encrypted banking system will happen as soon as it is possible. Your first payment will be delivered at approximately the same time.

Our Take on SCOTUS Conference Lists (“They’re Alive!”)

November 9, 2011

The U.S. Supreme Court notes on its public docket pages that a petition has been circulated for a particular upcoming conference. An entry that says something like, “DISTRIBUTED for conference of November 10, 2011″ lets counsel know to worry about particular orders lists that follow conferences — and worry they do. This sense of urgency also creates a nice time window for local media to write about petitions that have a local angle, which they also do.

http://certpool.wordpress.com/

The Cert Pool

The Court has a screening process for identifying cert-worthy petitions. Each petition is assigned to a law clerk from a “cert pool” made up of all of the justices’ clerks. That law clerk reads all the briefs and subsequently drafts a memo summarizing the case and the parties’ arguments. The clerk then recommends whether the Court should grant cert. The memo is then distributed to the justices, who have individual procedures for further consideration within their own chambers.

At some time before the justices’ weekly conference, the chief justice circulates a “discuss list” of all the cases for which a cert pool memo recommended granting review, as well as any additional cases the chief justice considers significant. Any justice may add any case to the discuss list before the conference, but only cases that appear on the discuss list are considered by the justices in conference; the rest are automatically denied without discussion or vote. Thus, for a case to have any possibility of success, it must make the discuss list. Cert is granted only to cases that receive favorable votes from at least four justices.

Joined: Aug 2006 Gender: Male Posts: 708 Location: Pasadena, CA Ninth Circuit Oral Argument « Thread Started Today at 3:29pm

We just received notice from the Ninth Circuit Court of Appeals that:
The court is of the unanimous opinion that the facts and legal arguments are adequately presented in the briefs and record and the decisional process would not be significantly aided by oral argument. The court orders this matter submitted without oral argument, on December 4, 2012.
There will therefore, be no argument of this case before the open Court; the matter will be decided on the record as it now stands.
Please consider: it may well be that the three Justices assigned to hear this case realized that the issues are well laid out and well briefed; and, perhaps they determined at their pre-argument conference on this case that they were all of one mind – in other words, they already unanimously agree on the result, and there are simply no areas of the law which need to be further discussed.

Sometimes in this midst of our day-to-day worries we forget some of the things that already exist, things that bring us reasonable hope for good outcomes in our CMKX lives.

Whether you know him as Robert Aime Maheu, “Iron Bob” Maheu, CMKX Director Maheu, or simply as “IBM”…he was a man who got things done, and shaped the future of many familiar events and circumstances in our lives.

Here’s what some had to say about him upon his passing in 2008:

ROBERT MAHEU: 1917-2008: His was the influence that backed Hughes’ cash Former spy brokered big deals that led to mob’s exit

By Ed Koch Wednesday, Aug. 6, 2008 | 2 a.m.

On his deathbed, Robert Maheu reminisced with his longtime friend Gordie Margulis about several moments in his life, but perhaps none as poignant as what happened on April 16, 1961, the night before the doomed invasion of Cuba.

“He didn’t mention it by name — the Bay of Pigs — but he said he went home that night and told his wife, Eve, to go to bed and then he put on some classical music,” Margulis said.

“Bob sat in his chair all that night and through the next day and did not move or say a word. He was despondent because he knew the United States was not going to back the invasion he helped put together. He knew those men were going to die and he couldn’t do anything about it.”

Margulis said his friend of 40-plus years was an honorable man who put love of family and friends and patriotism above all else.

“He was a giant, this guy — a giant with a heart,” Margulis said.

Margulis was at Maheu’s bedside when Maheu, best-known as the alter-ego of billionaire businessman Howard Hughes, died of congestive heart failure Monday night at Kindred Hospital on Flamingo Road at age 90. “Everything he did he did with enthusiasm and loyalty.”

Services for Robert Amie Maheu, a Las Vegas resident and businessman for 42 years, will be at noon Saturday at St. Viator Catholic Church, 4150 S. Eastern Ave.

In the late 1960s, Maheu helped the reclusive Hughes acquire Las Vegas Strip hotel-casinos, which began to rid the town of its mob influence and usher in the corporate age of gaming in Southern Nevada.

Maheu also was every bit the quintessential American spy — our version of the mythical British superspy James Bond.

Maheu infiltrated the German lines during World War II, providing misleading information to Adolf Hitler; spied on Hughes’ starlet girlfriends, and worked with the CIA and the Mafia to try to kill Cuban leader Fidel Castro.

The mark Maheu left on Las Vegas is indelible.

“Bob Maheu had as much to do with the transformation of Las Vegas as practically any other person who called Las Vegas home,” said Brian Greenspun, president and editor of the Las Vegas Sun.

“When he came here in 1966, Bob spearheaded Howard Hughes’ efforts to buy up a number of mobbed-up hotels on the Strip. Only men with Mr. Hughes’ money and vision and Bob Maheu’s tenacity could have succeeded in ridding Las Vegas of mob influence.”

That, Greenspun said, led to corporate expansion of the Las Vegas Strip, fueled by Wall Street and legitimate banks around the world.

“Without Bob Maheu, Las Vegas would be a very different and a far less successful place today,” Greenspun said.

Margulis, 76, Hughes’ longtime bodyguard, recalled that Maheu and Hughes, who never met face to face, would talk for hours on the phone.

“The others in the room got so jealous because Bob was Howard’s eyes and ears,” Margulis recalled.

“They tried to gain Howard’s favor and pitched their ideas to him, like banning smoking and the consumption of alcoholic beverages in Howard’s casinos. Howard got on the phone with Bob and said, ‘You’re not going to believe what they asked me to do now.’ ”

Maheu then had to spend hours on Hughes’ behalf arguing with the caregivers as to why outlawing smoking and drinking in Las Vegas casinos was not a good business move, Margulis said.

Maheu, also on Hughes’ behalf, delivered large sums of cash to high-ranking politicians to secure favors. Hughes’ memos to Maheu about one cash gift from Hughes to President Richard M. Nixon and the subsequent break-in of Sun Publisher Hank Greenspun’s office to try to steal those documents became part of the Watergate scandal that led to Nixon’s political demise.

Peter Maheu, the eldest of Maheu’s four children and a private investigator in Las Vegas, said Tuesday, “My father was a pioneer in so much history, not just in Las Vegas but around the world — and he was proud of that.”

Peter Maheu recalled his father’s work in sabotaging the deal that had given billionaire shipping magnate Aristotle Onassis a monopoly on shipping Saudi Arabian oil.

“If you think paying $3 or $4 a gallon for gasoline today is bad, you can imagine what we would be paying if my father did not play a major role in scuttling that deal,” Peter Maheu said.

By one report, Robert Maheu was even given a license to — if necessary — assassinate Onassis.

After one meeting with Maheu, then-Vice President Nixon shook Maheu’s hand and, according to the 1986 Onassis biography “Nemesis” by Peter Evans, said: “And just remember, if it turns out we have to kill the bastard don’t do it on American soil.”

Bill Maheu, Robert’s youngest son, said his father was a man of “strong values and ethics who always acted in a manner he felt was in the best interest of his country.” Still, he believes Robert Maheu would want to be remembered for something much more basic than that.

“My father’s legacy is his children, grandchildren and great-grandchildren,” said Bill Maheu, a retired police officer who lives in San Diego. “The historians will write the rest.”

Maheu was born in Waterville, Maine, on Oct. 30, 1917, and graduated from Holy Cross in 1940.

While studying law at Georgetown in 1941, he was hired by the FBI as a counterintelligence officer. He posed as a Canadian businessman and Nazi sympathizer to gather valuable information on the Germans.

One of his missions was to feed false information to two German spies who reported directly to Hitler. Maheu later was involved in the arrest of the two men whose confidence he had gained.

After the war, Maheu established his own investigative agency whose clients included the Central Intelligence Agency.

Maheu’s work for the CIA primarily was covert operations in which the agency could not be officially involved. They included the proposed assassination of Cuban dictator Castro and the Bay of Pigs invasion.

In 1960, the CIA directed Maheu to conspire with the Mafia to kill Castro, who had angered the mob by shutting down its casinos after coming to power.

Maheu contacted longtime Las Vegas Mafia henchman Johnny Rosselli to set up a meeting with mob bosses Santo Trafficante and Sam “Momo” Giancana to discuss how to pull off a gangland-style killing. Maheu told the gangsters the CIA was willing to pay $150,000 to have Castro killed.

But the CIA eventually shelved its assassination plan and Rosselli was killed to cover the conspirators’ tracks.

In testimony before the U.S. Senate Select Committee on Intelligence in 1975, Maheu defended his role in the assassination scheme as an act of patriotism, saying he felt the United States “was involved in a just war.”

In his 1993 book, “Next to Hughes,” Maheu wrote of that part of his life:

“Though I’m no saint, I am a religious man, and I knew that the CIA was talking about murder. They (CIA bosses) used the analogy of World War II: If we had known the exact bunker that Hitler was in during the war, we wouldn’t have hesitated to kill the bastard …

“But in my mind, justified or not, I would still have blood on my hands … If anything went wrong, I was the fall guy, caught between protecting the government and protecting the mob, two armed camps that could crush me like a bug.”

Maheu’s spy work brought him in phone contact with Hughes in 1955. Hughes was fascinated by undercover operations and hired Maheu to do counterintelligence work.

Hughes, a renowned playboy and filmmaker who discovered movie goddesses Jane Russell and Jean Harlow and married actresses Jean Peters and Terry Moore, also paid Maheu to spy on Hollywood beauties Hughes had designs on as well as on business rivals.

Hughes wasn’t Maheu’s only jealous client. Mobster Giancana hired Maheu to wiretap the room of Giancana’s girlfriend Phyllis McGuire, lead singer of the McGuire Sisters and a longtime Las Vegan.

In the 1995 film “Sugartime,” about the McGuire-Giancana relationship, Maheu was portrayed by actor Bill Cross.

Hughes stayed at the Desert Inn when he came to Las Vegas in 1966 and had Maheu buy it for him when the owners threatened to evict him after he turned a 10-day stay in their best suites into three months.

The purchase helped reduce Hughes’ tax burden from interest income generated by selling his stock in Trans World Airlines for $546.5 million.

Hughes then ordered Maheu to find him more hotel-casinos to buy to further shelter his windfall. Soon after, Maheu bought for Hughes the Sands, the Castaways, the Frontier, the Silver Slipper and the Landmark.

When Hughes and Maheu were finished buying, Hughes’ Nevada empire was valued at $300 million and included nearly every vacant lot along the Las Vegas Strip and 25,000 acres of prime real estate where the Hughes-built Summerlin master-planned community is now.

In 1969 and 1970, years when Hughes was seeking federal approval for airline acquisitions, Maheu delivered two bundles of $50,000 each in cash to Charles G. “Bebe” Rebozo, a Nixon confidante, as a supposed campaign contribution.

Nixon was paranoid about being linked to any gift from Hughes because in 1956, Hughes made a controversial $205,000 loan to Nixon’s brother Donald. Details of the loan were leaked during the 1960 presidential campaign and Nixon believed it cost him the election to John F. Kennedy.

Watergate burglars attempted to break into Greenspun’s safe at the Sun offices to get the Maheu-Hughes memos about that gift. They damaged the safe’s door but never broke it open.

Nixon also was concerned that Maheu had told one of his former employees, then-Democratic National Committee Chairman Larry O’Brien, about the cash donations from Hughes. O’Brien’s Watergate office was broken into, but the burglars were caught.

Maheu’s other business dealings included lobbying on behalf of Hughes to conserve Southern Nevada’s precious water resources and stop nuclear weapons testing at the Nevada Test Site.

Twice Hughes sent Maheu to Washington with briefcases containing $1 million in cash to secure promises from President Lyndon B. Johnson and Nixon to end nuclear testing in Southern Nevada.

But as Hughes became a bedraggled hermit, a rift developed between Maheu and Hughes’ caregivers, who answered to Hughes Corp. executive Bill Gay, with whom Maheu did not always see eye to eye.

(Hughes’ caregivers and aides were nicknamed the “Mormon Mafia” because the majority were members of the Church of Jesus Christ of Latter-day Saints.)

Maheu was fired by Hughes Corp. in 1970 and started his own consulting business, Robert A. Maheu and Associates.

In November 1970, Hughes was taken in a van by his caregivers from the Desert Inn to Nellis Air Force Base, where they boarded a jet for the Bahamas. Hughes never returned to Las Vegas.

After Hughes left town, many of Hughes’ memos to Maheu wound up on the front page of the Sun, accompanied by definitive stories about the reclusive billionaire and his mysterious ways.

“In Bob’s darkest days following the Hughes shake-up he had one true friend — that was my father, Hank Greenspun,” Brian Greenspun said. “And Bob returned that friendship to my family for the rest of his life.”

Hughes died April 5, 1976, aboard a plane from Mexico to his hometown of Houston at age 70. Though the official cause was kidney failure, Maheu maintained till the end that Hughes died of neglect.

“My heart still bleeds for what happened to Howard Hughes,” Maheu said in 2004. “I often said after I got off the phone with him that I just finished talking to the poorest man in the world. He was so unhappy.”

Maheu’s remains will be cremated and his ashes will be interred alongside those of his wife, Eve, at the family plot in Waterville.

Other Maheu survivors include his son Robert Maheu of Newport Beach, Calif.; daughters-in-law Rosemary Maheu of Las Vegas and Jane Maheu of San Diego; 10 grandchildren and six great-grandchildren. He was preceded in death by his daughter Christine.

Former Gov. and Sen. Paul Laxalt: “I don’t know of anybody who has contributed more to Nevada than Bob Maheu. He was one of the most gracious men I’ve known. He reminded me of Ron Reagan.”

Former Gov. and Sen. Richard Bryan: “There was a kind of commanding presence about Bob Maheu. He was very charming, elegant and very sophisticated. There was never any doubt that when you were talking to Bob Maheu, you were talking to a man with a commanding presence, substance and style. He carried himself with a sense of authority, but not arrogance.”

Former Gov. Bob List: “He was a big part of our history in this state in the last 50 years. He was a central figure in the development of Las Vegas (and) charming, a great raconteur who had a great amount of history in his head. In some ways he was as mysterious as Mr. Hughes himself. He loved his role and played it well.” —————— Source: See Las Vegas Sun article here

“Solving problems has been my occupation for many years,”

“Tough assignments are not solved by wishful thinking, but rather by tough action.” A new team of securities attorneys has been instructed that their prime assignment is to correct any deficiencies of the past and to cooperate fully with regulatory bodies both in Canada and the United States to minimize the possibility of such deficiencies in the future.”

“When I joined the board one of my prime assignments was to improve corporate compliance. A prime component was to reinstate reporting status, which was efficiently and expeditiously handled by the Stoecklein Law Group,”

“We are extremely appreciative of Stoecklein Law Group’s immediate attention to our needs. I have worked with them in the past and they have always exceeded my expectations,”.

“Like the SEC, protecting our investors is a primary concern. We have been aggressively gathering the essential information needed to comply with our public disclosure obligations and anticipate working with the SEC to ensure our compliance with all federal regulations,”

“We are not letting these regulatory matters impede our primary focus of creating stockholder value through the mining and development of our mineral assets,”

“I am fully committed to protecting the interests of bona fide CMKM stockholders, including if necessary, bringing appropriate federal or state court actions to ensure the appropriate distribution of the Entourage shares is made.”

“When I initially took on the assignment of assisting CMKM with its compliance needs, of primary concern was doing the right thing for the stockholders.”

“We faced a tremendous number of hurdles, including the trading halt, administrative hearing and let down of numerous professionals. However, with the continued commitment of Urban Casavant and diligent professionalism of Stoecklein Law Group, we are trying to overcome the obstacles of the past and look forward into the future towards distributing value to CMKM’s bona fide stockholders.”

“This is a time for the CMKM stockholders to look forward towards the future and forget the past. Working as a united front will allow us to extract all available sources of value for distribution.”

The right man, at the right time, for the right reason, protecting the rights of bona fide stockholders….The Right Honorable Mr. Robert Maheu.

CMKM Webinar NOTES 5.31.12
These are my notes from the webinar tonight. I may have captured something incompletely or inaccurately. Send me a PM if you see something needing correction.

Apart from an extensive answer for the questions surrounding the Jefferies issue raised during the last webinar, much of tonight was a repeat. I noted some of the same material in brevity. Refer to previous notes from the last webinar if you want more detail.

When it came to the Q&A session tonight, it was difficult to track the questions and answers. I did not capture all of them, only those that were easy to do or appealed to my interest. Watch for the recording on the company website if you want more complete detail. He thinks this time the MP3 actually worked and should be made available in a few days.

Again, much of this is repetition. Hopefully it provides some assistance for those unable to attend.

Happy to host these events and hopes everyone is learning a little more of what’s going on with the company and providing some level of transparency with the company and answer some questions.

He is doing two of these meetings each month as means of meeting the settlement with the 7 shareholders that sued the company recently—but it was something that he wanted to do anyway.

He felt the last webinar was helpful and he covered a lot of topics. Unfortunately the recording of the webinar didn’t work, so he is going to recap some of the same information to be sure everyone has the opportunity to hear it.

He contends this is still one of the most incredible stock stories in history—but there is no way for any one person to know every line, jot and tittle of every event that took place. This is about moving forward—not reliving the past.

Jeffries Letter
When he came on board with the company there was a lot of info for him to get caught up to speed on. When he took this job he didn’t know everything that had happened previously—nor was it is possible for him to garner all that knowledge. He took this job on a very short notice and went to work learning what he could.

At the last webinar he gave an un-researched answer to the Jeffries question—ludicrous on his part and he apologizes for not stopping and thinking before he answered.

The Jeffries Letter is a document produced by an attorney for Jeffries and was addressed to the NASD on May 6, 2005. The letter was an admission by Jeffries that the firm had approved transactions from two broker-dealers that requested trades in CMKX be settled on an “ex-clearing” basis. Over 111 Billion shares of CMKX were traded “ex-clearing” and were not reported to the “tape.”

The request was made due to the high cost of required deposits needed on “long” transactions that were cleared through normal procedures. Since CMKX was traded at a very low price, and in extreme volumes the deposits represented a burden to the broker-dealers and their clients.

A broker-dealer needs to cover long transactions with deposits—and since we were trading in such huge volumes, Jeffries was asked if they could trade these “ex-clearing” and Jeffries allowed it. Jeffries had created their own internal software that allowed them to breakdown transactions to amounts less than 10 billion shares.

Jeffries produced a spreadsheet listing the transactions in CMKX from 3.25.04 until 9.21.04 that were traded ex-clearing and submitted the SS to the NASD.

The letter was given to the CMKM attorneys by the SEC during discovery for the SEC Administrative Hearing in May of 05, which ultimately led to delisting CMKX. The letter is self-explanatory and is not an admission of naked shorting. Email Steve and he will send you a copy.

There is no evidence to indicate that Jeffries paid any fine or settlement monies to anyone. And he clearly misspoke last week during the previous webinar. A person can make all sorts of assumptions from the letter—but it doesn’t name any names, it didn’t involve naked shorting, it may have involved former insiders selling shares on blank certificates that they may have had, but basically it isn’t a tell-tale sign to anything in particular. It has no true bearing on where we are today other than noting the company was previously financially hurt by some of these previous activities.

RECAP FROM THE LAST WEBINAR

The Trimbath Report
The report has been the topic of many questions and speculation from shareholders. Trimbath was hired to do a low-cost forensic sampling of shareholder brokerage statements (about 30) searching for proof of naked shorts. Frizzell hired her himself and her work was far from comprehensive and only allowed and extrapolation of naked short/phantom share volume. Her report concludes that many phantom shares were sold and that some shareholders had their shares deleted by their brokers. The report cannot be released for public viewing due to the fact that it has some proprietary information from brokers. Steve insists there is nothing in it that would blow people away.

DTCC Global Lock Restriction
This is not a new ruling it actually began in 2006. Steve called the DTCC and left a message for Morris Richards but did speak with his assistant and all she would do is provide an email to further request information.

He spoke with Transfer Online—if your statement shows a global lock contact your broker and have him//her call Aaron White at Transfer Online 503-227-2950 for help and resolution. In spite of the global lock, there is evidence that many certs have been transferred broker-to-broker and broker-to-client since the lock was placed.
If you don’t get the help you need at Transfer Online, feel free to contact Steve directly.

2011 Tax Return
Not yet files—but an extension was requested. Work to complete the return is underway but was delayed due to an illness in the family of our accountant.

1010 JV and Core Samples
Still waiting on budget numbers from Mr Koch due to a serious illness with his daughter. Please refrain from calling him about this matter—he is very busy attending to his daughter’s serious crisis. Please pray for them both if you believe in prayer.

The Wells Fargo Lawsuit
Is ongoing and we are in the discovery phase. Estimated damages is about $60 million

Monies owed by Can Cal
We expect to collect. Accrued interest and principal stands at about $900,000 today.

Property Recover Efforts
Numerous properties have been identified. Three have been taken back and we will continue to reclaim them as soon as found.

The Board of Directors
He intends to seat a full Board by September 30. Two will be voted on by shareholders and will come from shareholders. Method of voting will be online and he is looking into the most cost-effective way to do that. He will take names between 7/15 and 8/15. The vote will take place on 9/30.

Steve will appoint three non-Shareholder BOD members prior to 9/30. This brings the total Board to five. One of these three non-Shareholder positions is committed at this time.

The Board will have to be proactive because the company needs real work to be accomplished to move the company ahead once we attain some operating capital.

Trade Again?
He has read many of the comments from folks on Proboards who are saying that there is no way for the company to move forward and Steve categorically disagrees. What he is looking for is a strong balance sheet, zero debt, proven claims or a product or service we can buy into and make money doing so. And while he mentioned that he likes real estate—some took that wrong—he isn’t set on any one thing…as long as we make money. We need a track record of stability and competent management first. And while it sounds great to be a diamond mining company—he hopes we understand that while it seems exciting, it is very expensive and challenging. His understanding is that Shore, for example, needs $2 Billion to get up and running just to start. And he feels that shareholders of CMKX would likely rather not wait for years and years to raise that kind of money.

The path to trading again isn’t all that difficult—but the path to share value requires a viable profitable company. We need to focus on being a company that makes money—no matter what kind of company that may be.

Rest assured, once the Board is seated and we have some capital we will do the wisest things possible to bring the company to the point where we are making money for all shareholders. He believes returning to trading is the best way to address the naked short issue. Going at it legally is extremely expensive, the SOLs have past and there is extremely challenging issues to overcome.

One shareholder brought forth the idea of going after smaller brokerages one at a time—but you need to keep in mind that kind of activity requires a law firm who will take such a case on contingency. Either that, or someone needs to come up with an extremely large amount of money to fund such a lawsuit. He’s looking for such a firm—but not confident he will find one.

The CMKM Business Plan
> Keep overhead low
> Raise cash through litigation and sales of reclaimed land
> Pay off all debt
> Test core samples
> Build stability and a strong Balance Sheet
> Build a viable company using seed capital to invest in profitable ventures
> Return CMKM to trading.

The Rumor Mill
Reverse Split? Not at all true—not on the table being discussed. We don’t want to RV and let any brokerage house off the hook if they sold NSS in this company.

Are meetings with various shareholders at remote locations? Not true—he is not meeting with anyone. He does talk with some shareholders by phone on occasion. You’re welcome to call too—but he doesn’t discuss anything that he wouldn’t say here. Some folks have been downright insulting, others have been encouraging, but there are no special meetings with anyone taking place.

Steve is working for the Government? He is not working for the Government and isn’t part of any kind of winding down or any means of occupying shareholders until things can be sewn up. All of that is completely ludicrous. He is the only guy left in terms of management and there is no big picture agenda at work in the background that can’t be discussed. That’s why he’s hosting these webinars—so you can discuss what it is you want to know.

Steve is part of a larger scheme or agenda? No, this is not true at all. The information shared on these webinars is truthful and based on hard fact or evidence provided to him by others. Any suggestion that his job is to provide covers for others or keep shareholders occupied or buy time is totally false and ludicrous. The purpose for these webinars is because he wants shareholders to trust their management—ask the questions they have, and learn the truth about what is/is not going on with the company. Hopefully over time you will see that what he is saying is completely factual—even if the facts, at times, hurt. He is committed to making this company one of the trustworthiest companies a person can invest in.

Poll Questions
Last webinar we did a poll, but the results were a bust because of glitches in the webex system, or he just didn’t understand the technology. Some folks didn’t have a way to answer some of the questions. There was roughly about 90-95 who tried to answer the following, but the answers till come later:

How many are interested in running for a Shareholder Rep on the BOD?

How many are interested in making a small investment (Say $100/unit) toward the 1010 core samples testing if the investment offered a preferred return once the claims are sold?

Are these webinars informative and helpful to shareholders base?

He would love to see shareholders have an opportunity to further invest in the testing of the core samples, but at the same time not see them invest so much it doesn’t prove to be an effective investment. He would like to give shareholders the opportunity to invest some first. He doesn’t want to put anyone at risk that doesn’t want to be at risk. If there is something of value then you would be in a preferred return.

Some Answers to the Q&A from the last Webinar

Lat/Long Coordinates for the 101047025 are: Lat 53-28-55 to 53-29-32 and Long 105-04-32 to 105-05-18 / SE ¼ section 18 Township 52 Range 21 W2

List of assets recovered to date: Parcel of land in Franklin Virginia which was sold for $312K, Parcel in Palm Beach County for $358K, parcel in Clayton GA for $362K.

Various small cash settlements from law firms and individuals that are covered by NDA’s as part of the settlement.

We are in process of trying to reclaim several other pieces of real estate. The overhead right now is very, very low. If we can any serious money it will stay in the bank for the most part as we plan what the company will do to bring value to shareholders.

Terms of Settlement from Shareholder Settlement (7 people)
Agreed to hold 2 shareholder/company webinars in April and May, then one per month thereafter.

A shareholder vote for two Shareholder Reps to sit on the CMKM BOD, which happens 9/30/12.

Plaintiffs will have the rights to examine corporate records per the laws of Texas as of June 1, 2012.

If the company has not secured legal representation with regard to the naked short issue by 8/16/12, then the plaintiffs can examine any company records related to NSS of CMKX.

Steve felt is was in the best interest to settle this lawsuit rather than go to court and risk the company have shareholders suing their own company.

5/31/12 Q&A Session

What is the date of the NOBO/OBO list?
He has no idea and wouldn’t hazard a guess. He will look into it.

It would be nice to have a part of this webinar as a recording.
He will post the link on this one in a day or two.

Who are the long sellers?
Doesn’t understand the question.

It sounds like you’re reading from a script provided by a lawyer.
LOL! He is not—reading from notes he put together himself. This borders on insulting. Bottom line—take it to the bank—he is not reading from a script or following someone’s marching orders. He is running this company as if he was the ONLY shareholder. He recognizes we have 50K shareholders and he trying to serve us the best way he knows how. He has notes, papers from research, but to suggest that someone is telling him what to say is ludicrous and absurd. Please get off that line of thinking.

What made you think that Urban is being indicted because he took payment from Jeffries?
He admits he was wrong, he apologizes and he didn’t mean to imply anything incorrect. He knows Urban is under indictment for federal charges…but admits he made a mistake regarding his comments re; Jeffries.

Why is Urban being indicted then?
Because the DOJ has evidence apparently that shows he broke the law and they were serious enough to issue an indictment. There are facts that point to some things that were improper. It is up to them to bring him in and the courts to decide. He is not here to try anyone improper over the internet.

What is the total number of phantom shares that Trimbath came up with?
There was no number she wrote—but he has heard some numbers from previous lawyers or management of the company of 800M to 2T, but he has not seen any verification. He is confident there is a large number that were sold naked.

Is Marco still selling shares?
He has no idea—hopes not, for Marco’s sake, but has no way of knowing. How could he know?

In your estimate what would be the value of our shares at this time?
He would have no idea nor a way to answer that.

Can trading start by the end of this year or early next year?
Is it possible, yes—but likely by the end of this year…probably not. It depends on what we end up with for capital.

Is it possible for a shareholder to create and sell shirts/hats with the CMKXM logo on them as a fund raiser for the company?
Yes, absolutely. He would welcome that. It’s a good idea—but he doesn’t want to turn this into a circus. He will look into it and address it next webinar.

If Al Hodges is successful and we have a windfall of funds, can we head back to trading sooner?
Yes, absolutely. But we need to be sure we’re a clean as a whistle, company wise, and that everything is in order before we move forward.

Why wasn’t the shareholder settlement made public?
But it was tonight and last week it was discussed. One shareholder posted some extensive recap of the webinar and it was cited there. We acted on that suit because it was in the best interest of the shareholders to keep the company from falling into bankruptcy.

Why wasn’t the funding from the land sold used to fund the core sample testing?
Understand, when he came on board with the company, there were salaries and other expenses that had to be paid first. Some of the funds he was not involved with and were handled by previous management. The Clayton GA property had a mortgage and a real estate commission and the legal counsel their share of their proceeds. That left some money in the bank. However, if we paid all the bills we owe we would be broke again. We owe some law firms, some back salary to previous company management. If there was enough to test the core samples—we would—and we will, once we get some money and we get a budget to know the costs to test those.

Who owns CMKM Tyler Texas?
The company is owned by its shareholders. There is only ONE CMKM Diamonds Inc, it is currently domiciled in Tyler but is moving to AL in the near future. It is the shareholders that own the company.

Can you provide us a photo of John Edwards mug shot?
He is indeed in jail in the UK. Unless he is being lied to by the FBI and the company’s legal counsel, he is in jail. But Steve has never seen a picture…but will ask for one.

Are Urban and Koch still friends?
They used to be, but Emerson indicated that they are no longer friends. It’s a personal matter, but he doesn’t believe they are.

Are we looking for gold or anything else on the 1010 Claims?
We will look for anything that might have value—diamonds, gold, uranium—whatever might have value. There’s zinc and potash up there and diamonds are the attractive mineral, but we also know the diamond market isn’t all that hot right now. Just the same we will look for anything of value.

If the government wins their lawsuit against the insiders, where would the money go?
If the government wins the criminal trial against the insiders and part of their final verdict and judgment includes that they need to pay restitution—the money would come to the company and the company will put it to good use for the benefit of all shareholders.

Ron Casavant, Urban’s brother still owns a home in Las Vegas. He was involved in CMKX and it is possible that he purchased that home with ill gotten gains from CMKX. Has that been investigated?
Good question—doesn’t know the answer to that. Ron has not been fingered or indicted on anything…but he will ask our lawyers. It is a good question.

Since you took control of CMKM Diamonds in November 2011 what efforts have you made to contact the other 49,500 shareholders that don’t know you’re holding these meeting?
I’ve not made any efforts because we can’t afford them. All we have are these webinars, our website and of course the boards. We cannot afford an effort to contact the entire list. He is getting a lot of calls and emails from people reengaging…but he could use some ideas on how to reach all of them affordably. He is open to any good idea.

How much money do we need to trade again?
He doesn’t know but assuredly a few million dollars in the bank and we need to be in apposition to provide a return to the shareholders, have a solid business plan, etc.

Will you set up a Pay Pal account so we can donate towards core sample testing?
Not sure just yet, but it will all be above board and completely transparent so all shareholders will all know where they money goes.

Maybe I am wrong but what would prevent our stock from being naked shorted again when we go back to trading? It seems we would still be in the same boat as before.
That’s an excellent question and comment. He has talked with Wes Christian and learned a lot about this process. It is possible we could be naked shorted again. If we go back to trading we need to be vigilant, proactive and monitoring the sales of our stock.

Was any money involved with the settlement with the small group of shareholders?
Absolutely not. If we ever pay money to shareholders, it will be to all shareholder.

All of the recovered assets have been sold and the monies have been used to pay off debt. And there’s currently no money to pursue any further recovery of assets. This leaves the Wells Fargo lawsuit to obtain further cash to continue operations. If we lose the Well Fargo lawsuit, will CMKM will be forced into bankruptcy?
Understand, the pursuit of other assets is being done on a contingency basis with the attorneys. So until we get the assets/property in hand, we don’t pay them anything. Wells Fargo is a contingency lawsuit plan. No, losing Wells Fargo will not put us into BK. He doesn’t intend to lose the case—we have the right lawyers and doing all we can to win the case. We have an iron clad case.

Does CMKM have a relationship with United Uranium?
To the best of his knowledge there is nothing currently in force, if there ever was anything to begin with.

Closing comments:

Any unanswered questions he will look up the info and respond to them later. Again he apologizes for the misinfo on the Jeffries letter. He wants the shareholders to be happy. Wants everyone to get their money back and then some. He understands its been a long ride, and many need money and help with their economic situation and he is dedicated to helping this company get profitable.

He feels he works for the shareholders and works hard everyday. Hopes one day we all make a bunch of money from this company. He appreciates the friendships he has made. Remember Emerson Koch’s family and daughter in prayer.

TO ALL CMKM SHAREHOLDERS:
Greetings to each of you from company headquarters! I hope this update finds each of you and your families in good health and with positive outlooks. This update is being published to summarize the details and activities from my recent trip out West on CMKM business.

Since my last update on February 15, 2012 I have had the privilege to communicate with many shareholders by phone, e-mail, and text. I have enjoyed getting to know each of you, and to exchange information and thoughts about CMKM – it’s past, present, and future. I consider our large and diverse shareholder base to be one of CMKM’s biggest assets.
As a brief introductory statement, let me say that my recent trip was both fascinating and very productive. I made stops in Texas, Las Vegas, and multiple cities in California. I met with numerous people and looked at numerous properties on behalf of CMKM. I truly believe that the things I saw and learned, the people I met, and the seeds of progress that were planted will reap benefits for the company in the days ahead.

MEETING WITH LAW FIRMS WITH REGARD TO POSSIBLE NAKED SHORT ACTION
My first stop was in Houston, Texas where I met with two law firms – one firm that specializes in litigation with regard to naked shorting of specific stocks by brokerage firms. The meeting was attended by Bill Frizzell, who knows as much about the history of CMKM as anyone, and by an attorney from the second firm that specializes in securities law.

It is an understatement to say that the meeting was truly fascinating. The law firm specializing in naked short cases is indeed highly qualified, well financed, and has been successful in obtaining settlements for companies that have suffered from naked shorting of their stocks. Typically, a case of this type costs literally millions of dollars to bring to trial, and is usually worked by multiple law firms on a contingency basis. The case must be very strong in order to entice these high-powered law firms to sign on and expend the funds and effort to bring the case to trial.

There is little doubt that CMKX stock was naked shorted during the time frame the stock was being traded. It has been speculated that anywhere from 800 billion to two trillion phantom shares were sold into the marketplace by brokerage firms without shares in hand to cover the sales. However, we face a major obstacle in pursuing a naked short action due to the fact that the statute of limitations limits litigation of this type after five years, and CMKX stock was delisted over five years ago.

There are other avenues that may allow us to pursue this naked short issue in spite of the statute of limitations problem. The three law firms in attendance are studying how to best tackle this case, and will do everything possible to find a way – most likely beginning with a RICO action in a single state with favorable RICO statutes, and expanding from there if successful.
Although I am not at liberty to name the law firms involved, I am confident that we have some of the best legal minds in America chewing on this matter. I will provide more information to you as decisions are made in this pursuit.

WELLS FARGO LAWSUIT
While in Houston, I met with one of two additional law firms we have brought on board to assist with the Wells Fargo lawsuit. These two firms have been successful in previous cases against Wells Fargo Bank, and add much firepower to our case. Due to the fact we have an ongoing case against Wells Fargo, I cannot share more details at this time. However, I am confident that we have excellent representation, and am determined to make sure that our lawyers pursue this case with intensity and vigor to insure CMKM the best chance of recovery in this matter.

MEETING WITH MR. EMERSON KOCH
My next stop was Las Vegas, where I had the pleasure to meet Mr. Emerson Koch in person. He is a fine gentleman, and truly has a heart for the CMKM shareholder base. We are very fortunate to have him as our partner in the 1010 Joint Venture.

Mr. Koch has maintained the 1010 claims in good standing for several years at his expense, and has drilled core samples on the 1010 lands that are stored in his warehouse in Saskatchewan. The 1010 JV agreement calls for CMKM to put up substantial sums of cash at intervals to follow the terms of the agreement. However, CMKM has not had the capital to honor our side of the agreement to date. By rights, Mr. Koch could have walked away from this deal long ago, but has been extremely patient as CMKM management attempts to rebuild the company’s finances.

It is clear that all of us want to know what the core samples consist of – are they filled with diamonds and other valuable minerals, or are they worthless samples? Many shareholders have contacted me with questions as to why we haven’t tested these core samples, and the simple answer is that we have not had the funds to honor the terms of the 1010 agreement, or the funds to test the samples.

The 1010 JV is a critical piece to the puzzle for CMKM’s future. A few shareholders have offered to put up money to help with the cost of testing the samples. Well, the day is fast approaching when the opportunity to invest in the core sample testing will be available.

Mr. Koch and I agreed that he will get quotes immediately and put together a budget for the testing of the core samples, and I will find a way to raise the money to get the testing done. I have several avenues to pursue in an effort to raise the funds needed for testing, with the most logical being the offering of “preferred shares” to individuals willing to invest in this venture. I am investigating the legalities of offering preferred shares, and looking at other funding options, including private venture capital.

I will provide more information on this project during the online company meetings which begin in April. The good news is that we will may soon be testing core samples if the needed funds can be secured!

VISITS TO NUMEROUS PROPERTIES BEING PURSUED FOR RECOVERY
I personally visited and viewed various properties in Nevada and California that CMKM is pursuing through legal actions. These properties were purchased by former CMKM insiders, and the company hopes to secure title and ownership to these properties through the large judgments we hold against these insiders. Once the company gets possession of these properties, I will attempt to sell them to generate operating funds and improve the CMKM balance sheet.

I looked at every property that we know about at this time, but we believe that there are many more properties that we will uncover eventually. There is an ongoing, daily effort to locate these properties, much of which is done by shareholders investing their valuable time for the CMKM cause. I offer a hearty word of “thanks” to these individuals for their great work.

The properties I saw rank from C+ to A- in terms of salability, in spite of the weak real estate market that exists in most of the U.S. These properties are just another piece to the CMKM puzzle – we need the chunks of cash that each parcel could generate to stabilize and strengthen company finances.

I also took a long ride from Los Angeles into the sparsely-populated areas of southern California, and located a large parcel of land that is pledged as collateral against a loan made by a former insider to another company several years ago. Due to judgments against these insiders, CMKM is entitled to the proceeds from the loan repayment, which is currently in excess of $900,000, but is in default. I have instructed our legal team to pursue collection/foreclosure efforts diligently in this matter. Due to the anticipated litigation, I cannot comment further on this matter at this time, but will update you at the appropriate time.

VISIT WITH MR. AL HODGES
My final stop was to meet with Mr. Al Hodges and Mr. Dennis Smith. I felt that meeting with Mr. Hodges was a very important part of my trip, and I was pleased and thankful that both men took time to see me in spite of busy schedules.
Our meeting was very cordial, pleasant, and informative. I came away from the meeting more convinced than ever that Mr. Hodges believes in his cause with all his heart. I truly believe he has invested all of himself, his reputation, and his legal expertise into seeking a return for the plaintiffs, and ultimately all CMKM shareholders.

I informed Mr. Hodges of all the efforts that are ongoing from the company side to rebuild value into CMKM. He assured me that none of our company efforts are or could be a hindrance to his efforts for recovery. I offered my assistance if it is ever needed to help bring closure to his recovery efforts, and he assured me that he would let me know if I could help somehow.

I asked Mr. Hodges what he would want me to share or relay to the shareholders at this time. His response was that he feels very strongly that the long-awaited funds will be released very soon, and that the battle is nearly over. So, I am reporting this to you, the shareholders, per Mr. Hodges’ comments.

Please understand that I have no “inside” information one way or another. However, I truly hope and pray that Mr. Hodges prevails for the benefit of all shareholders.

UPCOMING COMPANY WEBINARS
I am planning a minimum of two (probably more) shareholder meetings in the month of April. I am in the process of getting the necessary training to host these meetings, so I cannot announce firm dates at this time.

The web meeting room will allow up to 1,000 attendees, and will be recorded and archived on the company website for those who are unable to participate in the live event. During these meetings I will provide updates on company activities, and then allow plenty of time for questions.

My hope is to continue increasing company transparency and building shareholder unity and trust through these meetings. I may not have the answer to every question, but will provide honest answers to the ones that I can answer.
Please watch the company website for firm dates and times for these meetings, plus instructions on how to sign up and participate.

SALE OF CLAYTON, GEORGIA PROPERTY
We have a firm contract on the 24 acre tract in Clayton, Georgia. The closing is scheduled for April 11, 2012. I will report more about this sale during the online shareholder meetings.

SUMMARY
My current business plan for CMKM is very simple:
1. Cut overhead to the bone and keep it low.
2. Bring in cash from any and all available sources – recovery and sale of properties, collection of funds owed, and ongoing/future litigation recoveries.
3. Raise funds for the purpose of testing the 1010 core samples.
4. Provide honest, accurate information to shareholders.
5. Build shareholder unity and trust.

Of course, I hope all of these efforts translate to the rebuilding of a viable, profitable CMKM, and a return to trading. I am passionate about providing a return to you, our shareholders.

If you believe in prayer, pray for the company and for me as I endeavor to rebuild CMKM. I look forward to speaking to many of you during the online meetings. Take care, and God bless….

APOLOGIA 3/24/12

On New years eve, nearly three months ago now, I advised that Iraq is “… now a sovereign country, [and] will have an internationally recognized and tradable currency by January 1, 2012.” Premised on that understanding, I further advised that “…distribution of the CMKM pay-outs is truly imminent – with-in hours/days.” While I verily believed that information, and the conclusions based thereon, that condition has not yet come to pass. Although it was and remains true that Iraq is a sovereign country and does have internationally recognized currency, it does not yet have internationally re-valued tradable currency. My conclusions, while based on verified information, were premature; for that, I humbly apologize. I know the consternation and concern that has been caused; I assure you that that was never my intent, so I apologize for that as well.

In spite of this delay, I can still affirm to you that there was simply no other way to accomplish what will become the new foundation of this great country, and establish the agenda for its rebirth in form and fashion as originally set forth in the US Constitution. As I have previously stated, we continue to be confronted by the vilest, most contemptible, well financed forces for evil on the planet – and we have won! I know, all these months later, that while that might seem like an idle boast; it merely reflects the mighty struggle that has been raging in the shadows. Further, it reflects the concern and diligence of TPTB who are leaving no stone unturned to ensure that when all payees receive their funds, their funds will be safe.

Again, I apologize for prematurely advising that the currency re-set was essentially finished on 12/31/11, and expressing my opinion that if any “… additional delays are encountered, …… they will be de minimus in both time and substance.

Sincerely,
A. Clifton Hodges (CSBN 046803)
